By purchasing goods from Applied Truck & Trolley Ltd. you enter a legally binding agreement with us on the following terms. You should read and understand these terms because they affect your rights and liabilities.
These terms describe the basis for purchase by you and sale by us of the products described on this web site.
Definitions and Interpretation
In these terms the following words have the following meanings.
The contract for the sale and purchase of the Goods;
We deliver to all of the UK.
Details of the order
The quantity, quality and description of the Goods will be those set out in your order (if accepted by us). Orders are accepted at our sole discretion but are normally accepted if the Goods are available, the order reflects current pricing, you are based in the Delivery Area and your credit or account card is authorised for the transaction.
Price of the Goods
If the price of the Goods increases between the date we accept your order and the delivery date, we will let you know and ask you to confirm by e-mail that the new price is acceptable. If it is not acceptable then you will of course have the option of cancelling the order.
Details of applicable delivery charges are shown for each product on the website. Some areas may incur a surcharge, this will be confirmed at the time of ordering or enquiry.
Credit/Debit card payments will be charged at the point of order. Secure card payments are made using “PayPal”
The Buyer, if agreed in writing by the Seller, shall open an account with the Seller to use the Seller's account facilities. The Buyer shall open this account if the Buyer's bank details and the two trade references provided by the Buyer are approved by the Seller.
Subject to any special terms agreed in Writing between the Buyer and the Seller, the Seller shall invoice the Buyer for the price of the Goods on or at any time after delivery of the Goods and the Buyer shall pay all sums due under the Contract to the Seller within 30 days from the date of the Seller's invoice.
If the Buyer fails to make any payment on the due date then, without prejudice to any other right or remedy available to the Seller, the Seller shall be entitled to:
1. cancel the Contract or suspend any further deliveries to the Buyer;
2. charge the Buyer interest (both before and after any judgement) on the amount unpaid, at the rate of 3 per cent per annum above National Westminster Bank PLC base rate from time to time accruing from day to day, until payment in full is made.

Goods must be examined and signed for upon receipt. Applied Truck & Trolley Ltd. shall not be held responsible for any damages reported after a signature has been obtained.
We will never leave items unless they have been signed for. We cannot accept any liability for any loss or damage to the Goods once they have been delivered and signed for. We will aim to deliver the Goods by the date quoted for delivery but delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative time.
Risk and ownership
Risk of damage to or loss of the Goods passes to you at the time of delivery to you or, if you fail to take delivery at the agreed time, the time when we tried to deliver. You will only own the Goods once they have been successfully delivered and when we have received cleared payment in full.
The Buyer shall inspect the Goods immediately upon receipt ,your signature confirms that goods have been received in perfect condition. Signing “unchecked” is not acceptable.
If the Buyer fails to notify us immediately the Buyer shall be deemed to have accepted the Goods. Where a claim of defect or damage is made the Goods shall be returned by the Buyer to the Seller. The Buyer shall be entitled to a full refund (including delivery costs) plus any return postal charges if the Goods are in fact defective. Where returned Goods are found to be damaged due to the Buyer’s fault the Buyer will be liable for the cost of remedying such damage. Where we design a product to your own specification the Right to Cancel will not apply.
We aim to provide high quality products to our customers. Applied Truck & Trolley Ltd. warrants that the Goods will correspond with the specification in the Catalogue or Website at the time of delivery and will be free from defects in material and workmanship for a period of 12 months from the date of delivery.
Matters out of our control
We will not be liable to you or in breach of the Contract for delay or failure to perform due to a cause beyond our reasonable control.
In order to process your order and to provide you with the best possible level of service, we need to collect some necessary information about you. However, we only use the information we collect about you in accordance with the Data Protection Act 1999.
Applied Truck & Trolley Ltd. will not, under any circumstances, pass any of the information we have collected about you onto any third party. Our commitment to customer service ensures that all personal information is held securely, in accordance with both our internal security policy and the UK Data Protection Act 1998, to ensure that no other party is able to view your details.
If you wish to check the information that we hold about you, you can do this at any time by emailing us. If any of the information we hold is inaccurate we will delete or correct it immediately. Our security procedures mean that we may request proof of identity before we are able to disclose sensitive information to you.
Governing law and jurisdiction
These terms will be governed by English law and any disputes will be resolved exclusively by the English Courts.
